The terms of use and purchase set out below, and/or as detailed from time to time on the site, define the rights and obligations that apply when using the site and when ordering the products offered on it.

You are asked to read these terms carefully and thoroughly, as they constitute a binding agreement between you and the site management. Use of the site and/or ordering products from it constitutes agreement to these terms and to any further terms appearing on the site.

Parts of the site and of these terms are drafted in the masculine form for convenience only, but everything stated in these terms and on the site is directed at women and men alike, and at the singular and plural alike.

1. General

These terms are the legal basis for orders and for browsing the site, and they alone govern the relationship between the company and users of the site.

The company reserves the right to change these terms from time to time, to add to them or to remove from them, in relation to the site as a whole, to part of it, or to its features or applications, at any time at its sole discretion and without any need to give prior notice. Sole and full responsibility for familiarity with the terms below and for using the site in accordance with them rests at all times with the user alone.

The site is offered for the user to use on condition that they accept, without change, the terms contained in these terms. If the user does not agree to the terms, in whole or in part, the user is not permitted to make any use of the site for any purpose. The user making use of the site constitutes agreement to all of these terms in full and without reservation. For the avoidance of doubt, it is clarified that use of the site, including completing electronic forms on the site and/or placing an order through the site and/or ordering any of the services provided by the site operator, constitutes the agreement of the user to all of its terms without any limitation or reservation, and the user of the site declares that they have read these terms, that they agree to all of its provisions and terms, and that neither they nor anyone on their behalf shall have any claim and/or demand and/or action against the site and/or the company and/or the site management and/or any of its managers and/or its employees and/or anyone acting on its behalf, in connection with the provisions and terms of these terms.

Section headings are provided for convenience and ease of reference only and shall not be used for the purpose of interpretation.

The records of the company computers alone, regarding actions carried out through the site, shall constitute prima facie evidence of the correctness of those actions.

Product images displayed on the site are for illustration only. It is likewise agreed and clarified that the company will endeavour to do its best to present its customers with images that are as accurate as possible.

The company does not undertake to hold in stock all of the models whose images appear on the site, but the company does its utmost to ensure that the information presented on the site is the most complete and accurate information. It is clarified that inaccuracies or errors may appear on it in good faith, and the company shall bear no responsibility whatsoever arising from or connected with them.

All prices on the site appear on the products and are quoted in shekels. Prices include VAT, where it applies by law, and do not include shipping charges.

The site management is entitled to update the prices of the products on the site and the shipping rates from time to time and without any need for prior notice. The price applicable to the order you placed is the price published at the time you completed the ordering process (which includes providing credit card details). If prices are updated before the ordering process is completed, the customer will be charged according to the updated prices.

The site management is entitled to offer promotions, benefits and discounts on the site. The site management is entitled at any time to discontinue such promotions, benefits and discounts, to replace them or to change them, without any need to give prior notice.

The terms of use of the site apply to use of the site and the services it contains through any computer or other communications device (such as a mobile phone, handheld computers of all kinds, and so on). They apply equally to use of the site whether over the internet or over any other network or means of communication.

Products are purchased by a registered customer by completing the order form that appears on the site. Please note that completing all of the details is a precondition for the order to be placed.

The site management will not make any use of the customer details other than in accordance with the privacy policy of the site, which forms an integral part of these terms of use and purchase.

To ensure your order is processed efficiently and without problems, please take care to provide all the details requested on the site accurately. If incorrect or inaccurate details are given when the order is placed, the company will not be able to guarantee that the products reach their destination, and in any such case responsibility rests with the customer alone. Should the products be returned to the company because of incorrect details, the customer will be charged shipping and handling fees. Please take care to fill in accurate and current details.

When the customer places an order, the company will verify the credit card details, and once the order is approved by the credit card companies a notice will be sent to the customer confirming that the transaction has been approved.

The order details as entered by the customer on the order form, together with the record of the transaction on the company computers, shall constitute conclusive and final evidence that the process was carried out correctly.

If the transaction is not approved by the credit card company, the person placing the order will receive a corresponding notice and will be asked to provide another means of payment.

Approval of the purchase is conditional on the product actually being in the company stock at the requested supply date and/or at the time of the order. That said, even if it was not noted that the product is out of stock and the product was not removed from the site by the time the order was placed, the company shall not be obliged to sell the product, and the purchaser shall have no claim and/or demand in this regard in respect of any kind of damage, whether direct or indirect, caused to the purchaser and/or to a third party. The foregoing is subject to the site management refunding the customer any amount paid to the company, to the extent it was paid, and/or cancelling the charge to the extent it was made. It should be emphasised and clarified that there may be situations in which, although an item is shown on the site as being in stock, it is in fact not in stock and cannot be supplied. In such cases the transaction will be cancelled and the customer hereby waives any claim in connection with this, subject to the refund of the amount paid by them to the company.

Every customer is entitled to place an order and choose the requested delivery destination by updating the requested destination on the order form; however, the last delivery destination updated by the customer will be kept in the company database as the requested destination of the customer.

Please note that the company shall be entitled not to approve an order of a customer for any reason whatsoever and at its sole discretion, including, without derogating from the generality of the foregoing, in cases such as:

* If incorrect or inaccurate details were deliberately provided when registering on the site;

* If an act or omission was carried out that harms or is liable to harm the site or the site management, or any third parties, including the customers, employees and suppliers of the site management;

* If the services of the site were used to carry out an act presumed to be unlawful under the laws of the State of Israel, or in order to enable, facilitate, assist or encourage the carrying out of such an act;

* If the terms of this agreement, the terms of one of the binding documents, or the terms of any other online service offered by the site were breached;

* If there is a monetary debt to the company or to companies associated with us and the debt has not been settled, despite the due date for payment having passed;

* If the credit card of the customer has been blocked or restricted for use in any way.

Once the details have been provided, the binding documents approved and the consent of the customer given to the terms of use and the privacy policy, the site management is entitled, but not obliged, to display or send the customer updates via the account on the site or by email, including content updates, information about its services and products, as well as services and products of others, promotions and new items on the site, within the meaning of section 30A of the Communications Law (Telecommunications and Broadcasting), 5742-1982.

Once the payment details have been entered on the payment page, confirmation of receipt of the order details will be sent by email. Please note that this confirmation does not oblige the site management to supply the products; it only attests that the order details have been received by the site management.

If it turns out that the credit card of the customer is not valid, or that the credit card company does not honour the transaction, or that PayPal (or any other available electronic service) does not honour the charge, or that the requested product is not in the stock of the company, the site management will contact the customer in order to complete or cancel the transaction.

If you choose to pay via a PayPal account, you will be asked to enter the details of your existing PayPal account or to open a new PayPal account. Please note that if you decide to pay via a PayPal account, the company will only be able to collect payment for the products after receiving approval from PayPal. Use of the service and receipt of approval are subject to the terms of use and privacy policy of PayPal, and not those of the site.

3. Cancellation of a transaction and product return policy

The provisions of this section are subject to the Consumer Protection Law, 5741-1981.

The person placing the order (and not the company) may cancel the order that was made, in each of the cases and under the conditions set out below:

In the case of cancellation of a transaction after the product has been sent to the person placing the order and after the goods have been received at the company warehouse, a full refund will be given to the customer, less the shipping costs paid when the product was ordered.

The refund will be given on condition that the product is returned unused and without defect or damage. If the product is returned other than as stated in this section, the person placing the order will not receive any credit (neither a monetary refund nor a credit voucher). It is likewise clarified that the company shall have sole discretion regarding the condition of the returned product. It is clarified that an item that has not been used may be returned in its original packaging within 7 days at the latest from the day it was received.

Any refund will be transferred only to the credit card with which the order was placed, and in accordance with the timetables of the credit card company.

It is clarified that no monetary refund will be given in respect of products for which no monetary consideration was paid, such as promotions or gifts.

4. Returning products

Returning a product by registered mail: a product may be returned by sending it to the company free of charge by registered mail. The company details and the instructions for returning products via Israel Post are attached to every order. It is clarified that if a product is returned to the company and exchanged for another product, returning the product (and not sending the product to the customer) on the second occasion and on any subsequent occasion, to the extent there are any, will be at the expense of the customer.

Returning a product via courier: if the customer wishes to return a product via a delivery company, they must send an email to the customer service of the company at [email protected]. The customer will set out the reason for the return and will ask the site management to send a courier to their home to collect the product, in which case the return is at the expense of the company. If the courier arrives at the home of the customer and the customer is not at home, the customer will have to pay for a further collection in order to return the product, and they shall have no claims whatsoever against the delivery company and/or against Efrat Cassouto.

Please note: an item purchased on promotion may be returned within 7 business days only and without the option of a monetary refund, but rather for exchange for another item or for receiving credit on the site.

5. Supply and shipping

Supply of the products to purchasers is carried out via a delivery company or by registered mail, within the supply times detailed.

In this part, the following terms shall have the meanings set out below:

Day of supply of the product: the day on which the product was delivered to the requested destination.

Postal delivery address: the address entered by the person placing the order on the order form as the address for sending orders.

The requested date for supply of the product: the date entered by the person placing the order as the date on which they prefer the product to be supplied to them.

Day the order was placed: the day on which the transaction was approved by the credit card company entered by the person placing the order.

Business days: weekdays, Sunday to Thursday, not including Friday, Saturday, holiday eves and intermediate festival days.

The shipping options and costs when purchasing from the site are as follows:

Self-collection: the selected product may be collected free of charge from our office, by prior arrangement only.

Courier delivery: after the order has been received and approved, the product will be sent to you within up to 7 business days from the time the order was placed on the site, via a delivery company. Deliveries cannot be made on Fridays and holiday eves. To make the delivery to you more efficient, when purchasing on the site we recommend choosing delivery to an address where you are present for most of your day: at work, at home, or at any other address of your choosing.

* Please note that because shipping is carried out by an external delivery company, delivery times may vary for reasons beyond the control of the company.

Registered mail for sending the product: after the order has been received and approved, the product will be sent to you within up to 14 business days from the time the order was placed on the site, by registered mail.

* Please note that because shipping is carried out via Israel Post, delivery times may vary for reasons not dependent on the company.

Delivery areas and supply of products

As a rule, an order may be placed on the site for all areas of the country, except for areas located outside the territory of Israel. That said, the ability to order products on the site is limited to areas in accordance with the distribution area map of Israel Post or of the delivery company. The company is entitled, but not obliged, to provide the service outside the distribution areas as well, by prior telephone arrangement. In such a case, even if the order was received and recorded on the site computers, the company shall not be obliged to supply it. If you live in areas with restricted access for security reasons, the delivery company will arrange a nearby collection point with you by prior arrangement. If the delivery address is in localities the courier company does not reach, the order will be sent by registered mail.

The company cannot take responsibility for delivery times and delays of the various delivery companies, but we will be at your disposal in order to resolve any problem.

The supply dates detailed above do not apply to products that are out of stock.

The products ordered will be supplied after the purchase process has been completed, provided that the order was received within the transaction time range as defined on the page of the requested product, provided that the customer holds a valid credit card that can be charged and cleared in Israel, and provided that the credit card company that issued it has approved the transaction that was carried out.

The company and/or the site management and/or anyone on their behalf shall not be liable and shall not bear any direct, indirect, consequential or special damage caused to the user and/or to the browser and/or to the person placing the order and/or to a third party, as a result of use of or purchase through the site otherwise than in accordance with these terms, whatever the cause of action may be, including loss of income and/or prevention of profit caused for any reason whatsoever, in which case the company reserves the right to cancel the specific order.

Product images on the site are intended for illustration only, and there may be differences between the images displayed on the site, in part or in full, and the products actually sold. In any event the company shall bear no liability exceeding the value of the product purchased, nor for any damage that is not direct and/or consequential damage.

The site management shall not be responsible for delays in supplying the products as a result of events beyond its control, such as faults, delays, strikes, natural disasters, faults in the computer system or in the telephone systems that affect the completion of the purchase process, or faults in the email service.

The site management will do its best to supply quality products at the requested time. If the customer believes that the products purchased through the site or the services are defective in any way, they are invited to contact customer service on 03-5161334 between 10:00 and 19:00, and the site management will handle the enquiry as early as possible.

6. Copyright

Copyright in all information appearing on the site, including the images, the media, the articles and the text on the site, as well as the design of the site, in all software applications on it and any other module connected with the site, are the property of the company alone, unless expressly stated that they belong to another. No information from the site may be copied, reproduced, distributed, sold, marketed or translated, including trademarks, images and texts and the like, without obtaining the permission of the company in advance and in writing.

No commercial use may be made of the data published in the database, in the list of products appearing on it or in other details published on it, without obtaining the consent of the site management in advance and in writing.

No data published may be used for the purpose of displaying it on the site or in any other service whatsoever, without obtaining the consent of the site management in advance and in writing and subject to the terms of that consent (to the extent it is given).

The name Efrat Cassouto, as well as the domain name of the site and the trademarks (whether registered or not) are all the property of the company alone. No use may be made of them without obtaining consent in writing and in advance.

To the extent that there are trademarks (including images, drawings and the like) that were provided for publication by the companies offering products and services for sale on the site, then those trademarks are the property of those companies and no use may be made of them without their consent.

All verbal content, icons and any information and/or display appearing on the site, including graphics, design, verbal presentation, trademarks and logos, including their editing and presentation on the site, are the exclusive property of the company and the owners of the company.

The services of the site must be used for lawful purposes only and subject to all law.

Content from the site may not be copied and used, nor may others be permitted to use it in any other way, including on other websites, in electronic publications, in print publications and the like, for any other purpose.

7. Maintaining confidentiality

The company does not store credit card numbers on its computers.

The company uses the highest security standards in order to protect, as far as possible, the confidentiality of the information and the privacy of its customers. The company uses Pelecard, the leading credit card clearing and security company in Israel, for the purpose of verifying and securing the information.

Pelecard meets strict information security standards and procedures as required by the credit card companies (PCI level 1 standard).

In cases that are beyond its control and/or arise from force majeure, the company shall bear no liability for any damage of any kind, indirect or direct, caused to the customer or to anyone on their behalf, if information is lost or reaches a hostile party and/or is used without authorisation.

The company undertakes not to make use of the customer details registered on the site other than for the purposes of operating the site alone, and in order to enable the order to be carried out and information to be conveyed to the customer.

The site management makes an effort to provide the customer with a proper, high-quality service. That said, the site management does not undertake that the service on the site will not be disrupted, that it will be provided regularly or without interruption, that it will operate securely and without errors, or that it will be immune from unauthorised access to the computers of the site management, damage, malfunctions, faults or failures, including faults in hardware, in software or in the communications lines to the site, at the site management or at any of its suppliers.

9. Warranty on Efrat Cassouto jewellery

Efrat Cassouto jewellery is designed and produced by hand and undergoes rigorous quality control. If nonetheless the piece of jewellery you purchased needs repair, do not worry, you have a warranty on it.

All you need to do is come into our store and hand the piece in for repair. Alternatively, you are welcome to send the piece to our studio by registered mail, with accurate and clear address details. We will repair it and return it to you by registered mail.
